The Data Protection Regulation, GDPR, came into force in 2018 and means, among other things, that the rights of individuals are strengthened. Such a right is the right of access which means a right for individuals to find out what personal data a business handles about the person in question and to obtain information on how this information is used. IMY has examined how Spotify handles the right of individuals to access their personal data. IMY considers that Spotify discloses the personal information the company processes when individuals request it, but that the company does not provide sufficiently clear information on how this information is used by the company. Customers who have turned to Spotify to request access to their personal data have been able to choose which personal data they want to have access to by Spotify having divided customers' personal data into different layers. In one warehouse, the information that Spotify deemed to be of greatest interest to the data subjects, such as the customer's contact and payment information, which artists the customer follows and the listening history for a certain time. If the customer wants more detailed information, such as all technical log files relating to the customer, it has also been possible to request these in another warehouse. The purpose of the right of access is to give individuals the opportunity to verify that the processing of their personal data is legal. The fact that the individual receives sufficient information is often a prerequisite for exercising other rights, such as the right to have incorrect information corrected or deleted. Since the information provided by Spotify has been unclear, it has been difficult for individuals to understand how their personal data is processed and to check whether the processing of their personal data is legal. Spotify has taken several measures to meet the requirements for individuals' right of access and the deficiencies detected are considered to be of low severity. In light of this and, among other things, the number of registered and Spotify's turnover, IMY issues an administrative penalty fee of SEK 58 million against Spotify because the information the company provided to individuals was not sufficiently clear.
