Abbiamo effettuato delle analisi ad hoc.

Oggi su Linkedin ci si chiede se sia sufficiente definire "possibile" il Legittimo interesse nell'uso della AI.

Sufficiente a consentirne l'uso.

Credo sia abominevole pensare di poter usare una tecnologia solo se riesce a documentare di averne diritto.

Dovrebbe essere il contrario, cosi' come tutti possono andare in giro, salvo specifici divieti.

Ma il diritto, oggi, e' quello della paura, e non possiamo non tenerne presente, spiegando rischi, cautele e opportunità.

In area riservata le analisi genai.

Is the Proposal of AI training based on legitimate interest under the Digital Omnibus Enough?

Below is the wording contained in the current proposal of EU Digital Omnibus, it was expected, but I also expected something more. Indeed, my hope was to have a more straight forward provision such as what provided by the ePrivacy Directive for the soft opt-in exception that does not leave much discretion to data protection authorities.

On the contrary, this provision is good since it clearly states that under some conditions legitimate interest "may" be the legal basis for AI training. However, it sets several criteria to be met whose fulfillment might be left to the discretion of privacy authorities.

What do you think? Would you have preferred a braver approach by the EU Commission or this is the best we can get? Will this provision have an impact on pending disputes between LLMs providers and privacy authorities?

The first step is put the hands in files. A model does not contain personal datas (token and embedding are different 'cause the way they are calculated). AI systems makes usually further processings, so the first step is to define a model not like a database. It is not.

EDPB already affirmed that may ben based on legitimate interests. Nowadays some authorities repeats it could, but 'cause models can't declare the sources (so they are not accountable), all existing models are not respeciting laws, so there is no legitimate interests do justify the use.

I'm missing something ? :)

The issue is that the EDPB guidelines set limits that are too stringent for the lack of processing of personal data and basically are not feasible. That's why I expected more from the Digital Omnibus proposal.
