La vittoria di Pirro, si può titolare.

La Corte decide che siccome in Italia c'è un numero alto di medici obiettori, ci sono donne gravide che possono essere costrette a cambiare ospedale per andare in altro in Italia o all'estero.

Per questo afferma che la situazione è identica alla precedente condanna e condanna nuovamente l'Italia.

Quali le prove ? Il numero di medici obiettori.

Non ho visto altre prove.

In poche parole: lo Stato deve favorire che vi siano più medici non obiettori.

Invece di difendere chi, in maggioranza, ritiene la legge ingiusta.

Insomma, è confermato: il diritto di obiettare resta. E ci mancherebbe.

CONCLUSION
For these reasons, the Committee:
-  unanimously declares the complaint admissible  and concludes:
- unanimously that there is a violation of Article 11§1 of the Charter  

- by  9  votes  to  2,  that  there  is  a  violation  of  Article  E  read  in  conjunction  with  Article 11 of the Charter  
- by  6  votes  to  5,  that  there  is  a  violation  of  Article  1§2  of  the  Charter  ;  i)  first  ground
- unanimously  that  there  is  no  violation  of  Article  1§2  of  the  Charter  ii)  second  ground
- unanimously that there is  no violation of Article 2§1 of the Charter
- unanimously, that there is no violation of Article 3§3 of the Charter  
- By 7 to 4, that there is a violation of Article 26§2 of the Charter and
- unanimously  no  separate  issue  arises  under  Article  E  taken  together  with  Article 2§1, 3§3 and 26§2 of the Char
